Example Contract
This is an example of the type of contract you would sign when completing a sale . There are many areas which can be changed and altered depending on:
- What stage you decide to purchase your property - you may be able to spread payments over the period until the property is completed if buying off-plan.
- Early or quick completion of sale may allow certain other items to be included in the cost of the property e.g.
          - air-conditioning units in some or all of the rooms
          - some furniture such as beds or sofas
          - soft furnishings such as curtains
          - white goods including washing machine, cooker, fridge-freezers
 
All contracts are made with you and our English speaking solicitors to ensure you are happy with every step of the contract details. The contract is always officially translated into English to ensure you are fully aware of all clauses and your own and our responsibilities in the transaction.

The Parties agree on the following terms and conditions for the sale and purchase of the property specified above:

1) The SELLER agrees to sell the above property priced at 88,500 GBP. The price is fixed and shall not be varied subsequently.

2) The BUYER agrees to buy the property for the price stated in (1), to hold the contract 2,500GBP shall be taken between 12,07,2007 and 18,07,2007.

3)The rest of the payment 86,000 GBP shall be paid by cash till 30,07,2007.

4) In case of disagreement on the terms and conditions of this contract, the defaulting party shall cover the loss to the other party which may have occurred due to the terms of contract.

5) The deed expenses which are 3% of the purchase tax, military permission application expenses shall be paid by the Buyer.

6) The parties agree any default on the terms and conditions of the contract shall mean a lawful reason to terminate the contract by the other party and the penalty shall be applicable. The rights of the parties arising from the the Turkish laws and in particular the Turkish Code of Obligations Article 156(2) shall be strictly reserved.

7) The parties declare that they have read, understood the terms and conditions of this contract and signed with their own will.

8) This contract shall be governed by Turkish law. To resolve any conflicts arising under this contract, both contracting parties submit themselves to the jurisdiction and competency of the courts where the property is located which is Fethiye, expressly renouncing any other court or jurisdiction.

9) This contract shall only be valid if presented attached to the Turkish version of it. If any ambiguity arises in the interpretations of the Turkish and English texts of this contract, the Turkish version shall prevail.  The English version is merely to assist those who do not understand Turkish.

10) This Contract consists of (10) clauses and (2) pages – English  versions – signed by the Parties and the agent on the date of     ,07,2007(date).
